Arbitration

One other/alternative way to resolve disputes is through arbitration. This is a private, out-of-court process in which a neutral third party, known as an arbitrator, hears evidence from both sides and makes a decision that is legally binding on the parties.

Here are some of the specific legal services which are provided by us in relation to (non-specialist) commercial arbitration:

  • Advising on the suitability of arbitration as a dispute resolution mechanism:
  • Drafting arbitration agreements
  • Pre-hearing conferences
  • Representing parties in (non specialist) arbitration proceedings
  • Drafting of cause papers/pleadings,
  • Filing of/appearance for interim applications to the tribunal/courts.
  • Negotiating Settlement
  • Selecting arbitrators and challenging arbitrators for bias or conflict of interest
  • Conducting the arbitration hearing, including presenting evidence and cross-examining witnesses
  • Drafting post-hearing submissions/briefs and applications
  • Enforcing or challenging arbitration awards in court

We assist in navigating the arbitration process for purposes of achieving a resolution to your dispute that is fair and cost-effective.
